The High Court has struck out an insolvency petition seeking the liquidation of the Kenya Union of Savings and Credit Co-operative Societies Limited (KUSCCO), ruling that a co-operative society cannot be wound up through the Insolvency Act.
Justice Rhoda Rutto upheld a preliminary objection by KUSCCO and found that the Co-operative Societies Act provides a separate statutory framework for the dissolution and liquidation of co-operative societies.
