LAKE CHARLES, La. (KPLC) – Figuring out your next steps after your employer files for bankruptcy can be a very stressful task. When your employer owes you unpaid wages, it can be even more of a challenge. So, what should you do?
First, a proof of claim must be filed with the United States Bankruptcy Court in the jurisdiction where the bankruptcy was filed.
“Filing that claim will give the employees priority over other creditors, generally speaking. That proof of claim is what will give the employees footing and standing to be able to claim their unpaid wages,” La Koshia Roberts, an attorney with the Southwest Louisiana Law Center, said.
Roberts said that while an attorney is not necessary in this case, she usually recommends one.
