Former employees of a liquidated uPVC window and door supplier have won an employment tribunal case over a failure to consult them before they were made redundant.
The 65 ex-staff members of ERV Group, which traded as Evoframes, won the case, which claimed that the company failed to comply with section 188 of the Trade Union & Labour Relations (Consolidation) Act 1992.
The finding means that staff are owed 90 days ‘ pay for the period during which they should have been consulted.
The cost of such action often falls on the taxpayer-funded Redundancy Payments Service.
It is the latest in a long line of similar actions regarding defunct contractors in recent years.
