When the Insolvency and Bankruptcy Code (IBC) came into force in 2016, it was presented as a legal fix to expedite bankruptcies. It turned out to be much more: a structural reset of incentives that has rebalanced power in Indian business, revived credit markets, and crucially — altered the behaviour of promoters.

At the heart of the Code was a simple, hard-nosed idea: make default costly. Under the IBC, a default can trigger a creditor-controlled resolution process with strict timelines (the ordinary Corporate Insolvency Resolution Process is to be completed in 180 days, with a limited extension window; a fast-track regime for smaller firms runs 90 days, extendable once by 45 days). Fast forward five years, and sadly the industry is coming to terms with the failure of ISG: another huge contractor with a multi-billion pound turnover, employing more 2,000 people working across some of the biggest projects in the public and private sector.

But while ISG is undoubtedly the biggest name to fail since Carillion in 2019, the sector has also lost significant players such as Buckingham Group, Osborne, Henry Construction and Inland Homes recently.

Indeed, out of all industries, the construction sector accounted for 17% of corporate insolvencies in the 12 months to June 2025. It has been a consistent theme for a number of years as insolvency continues to be a major concern for the sector.

The National Company Law Tribunal (NCLT) on Tuesday (November 11) issued a notice to online gaming platform WinZO following an insolvency plea filed by Paytm’s parent company, One97 Communications Ltd, which claimed unpaid dues of around ₹3.6 crore for advertising services.

The matter was heard by a Bench comprising Justice Jyotsna Sharma (Judicial Member) and Anu Jagmohan Singh (Technical Member). The tribunal granted WinZO two weeks to file its response, with the next hearing scheduled for December 15.

In her ruling, Judge Simone Gastesi Chevrand, of the 7th Business Court of Rio de Janeiro— where the company’s restructuring case is being handled—ordered the suspension of all lawsuits and enforcement actions against the telecom carrier, as well as a ban on any sale or encumbrance of the bankrupt entity’s assets.
