Indias new insolvency and bankruptcy regime has been functioning for a year without any disclosure norms or mandatory transparency regulations. In the first year of its application, the regime is already dealing with more than 450 cases that add up to thousands of crores of rupees of unsettled debts. Neither the details of the cases being dealt with nor the deliberations over the case by creditors behind closed doors nor the final decision of either resolution or liquidation are being put out in public.

This has led to rumours and controversies about the decisions being taken by the tribunals set up under the regime, as well as the deep discounts banks and other financial lenders have had to take to settle their debts.

Aerion Corp. plans to sell as much as $200 million in debt as it teams up with Lockheed Martin Corp. to build a private jet that flies faster than the speed of sound.

Its the first time Aerion, backed by Texas billionaire Robert Bass, has sought outside financing for its AS2 supersonic jet, a project the company has been working on since 2003. The aspiring planemaker hired Goldman Sachs Group Inc. to help with a debt sale that could take place within a month, said Brian Barents, executive chairman of Aerion.

Petitioner Francis Kikin Siune filed the petition on two grounds. The first was on errors and omission on the part of Electoral officials in accepting the nomination of Palma to stand for public office at the time he was declared bankrupt.

The second ground in the petition is that, after he was declared bankrupt by the National Court and elected as a member, he was not qualified to remain an MP.

Palma was declared insolvent, or bankrupt, by the Waigani National Court on June 1 after failing to pay legal costs from 2012 General Elections.

Tackling NPAs

The government has taken the high moral ground to deal with the menace of non-performing assets or NPAs that have brought many public sector banks on the verge of bankruptcy. It sounded the bugle for errant promoters with its ordinance of November 23 amending the Insolvency and Bankruptcy Code (IBC) 2016.
