Deputy president Maijol Mahap says annulment under Section 105 of Bankruptcy Act 1957, wipes out prior bankruptcy order, putting Lajim Ukin back as he was in party.

Maijol-Mahap-Lajim-Ukin-Parti-Harapan-bankruptcy-orderKOTA KINABALU: Parti Harapan Rakyat Sabah founding president Lajim Ukin did not lose his position in the party despite having been declared a bankrupt recently, claims his deputy Maijol Mahap.

In explaining the latest development over the controversy surrounding the Sabah-based opposition partys president, Maijol said the bankruptcy did not take effect as it was annulled immediately.

In a statement on Saturday, Maijol said though Lajim had lost his presidency as per Section 9A of the Society Act 1966 after being d…

Eclipse Resources, the Perth waste-management company that unsuccessfully battled the State Governments landfill levy, has been placed in administration owing taxpayers tens of millions of dollars.

A notice filed with the corporate regulator this week shows a meeting of creditors will be held at the CBD offices of law firm Herbert Smith Freehills next month as part of efforts that could lead to Eclipse being wound up.

The move follows the decision by the High Court this month to effectively end Eclipses legal fight by rejecting its bid to appeal a WA Court of Appeal judgment that shot down its case.

Eclipse has been fighting a long and ultimately losing battle through the courts over having to pay the landfill levy, which it stopped paying …

A TRUSTED office manager who stole almost £50,000 and plunged a family business to the brink of liquidation has walked free from court.

Nicola Leadstone was taking an average of £500 a week but her barrister claimed there was no evidence of her living high on the hog.

Yet Teesside Crown Court heard yesterday she bought a car, furniture and funded two family holidays during her two-year thieving spree.

Leadstone, 37, said in a letter written to the court: I understand the effect my crimes will have on everybody. I am deeply sorry.

Not only were they my colleagues, they were my friends, and I have let them down. It is a decision I will regret for the rest of my life.

Leadstone worked for Middlesbrough I…

Profits at Twitters UK arm slid by 21pc last year despite almost £80m in advertising sales.

Profits fell to £2.7m, partly due to a £1.4m restructuring expense, though the company said performance has been in line with expectations. The company has struggled to make money since starting in 2006.

The restructuring expense was Twitter UK’s contribution to the cost of reorganising the business after wider job cuts from its US parent. However, the UK part of the business actually increased its staff numbers in the country by 24 people, to bring the total number of UK employees to 187.

Its corporation tax for the year was £815,000, the accounts show, compared with £1.24m the year previously.

Twitters UK accounts do not include any busin…

MAJOR corporate restructuring at Sunshine Coast Council is set to radically reshape the organisation with three of five of its most senior directors deciding not to recontest new positions.

Director of Infrastructure Services Andrew Ryan and Director of Corporate Services, Ray Turner, will leave the organisation after long careers next Friday with Director of Community Services, Coralie Nichols to follow a week later.

At this stage it appears only Director of Corporate Strategy and Delivery, Greg Laverty, and Director of Regional Strategy and Planning, Warren Bunker, have chosen to contest new positions as part of a restructure unanimously backed by councillors at a closed-door meeting on September 19.

The new organisational structure woul…

MUMBAI: A subtle tension is brewing between bankers, struggling with failed borrowers, and auditors, having come under closer scrutiny. Till now auditors who signed the financial statements of banks have rarely questioned the real worth of assets and securities that banks hold to lend. But, this is about to change with auditors coming under the glare of regulators and many Indian defaulting companies headed for a change of ownership and control.

As they begin to scan banks numbers for the quarter ended September 30, auditors will, for the first time, take a hard look at the actual realisable value as against the `book value of assets and securities pledged with banks. If auditors suspect that the realisable value of a borrowers land,…

The Insolvency and Bankruptcy Code may have prescribed a minimum vote of 75 per cent in a creditors committee before any decisions are taken in the insolvency process, but the countrys courts are interpreting this quite differently. Two benches of the National Company Law Tribunal (NCLT) have interpreted the law to mean the biggest creditor calls the shots. While this might hurt the interests of the smaller creditors, the benches seem to be arguing that it will hasten the process of winding-up.

MUMBAI: Telecom operator Aircel may start an independent debt restructuring programme now that its proposed merger with Reliance Communications has fallen through, people aware of the firm’s alternative plans said.

In an email sent to employees on Sunday night, Aircel chief executive Kaizad Heerjee said that while decision to call off the merger with Reliance Communications (RCom) “was disappointing”, the company needs “to move ahead and explore other business options”. ET has seen a copy of the email.
