The Supreme Court of India has, yet again, stepped in to arrest the creeping tendency of corporate debtors to stall Corporate Insolvency Resolution Process (CIRP) by raising spurious defences. In M/s. Saraswati Wire & Cable Industries v. Mohammad Moinuddin Khan & Ors. [Civil Appeal No. 12261 of 2024, decided on 10 December 2025 – 2025 INSC 1410], a Division Bench of Sanjay Kumar and Alok Aradhe, JJ. set aside a 13 March 2024 order of the National Company Law Appellate Tribunal (NCLAT) and restored the admission order passed by the National Company Law Tribunal, Mumbai Bench-IV, thereby allowing the operational creditor’s Section 9 petition under the Insolvency & Bankruptcy Code, 2016 (IBC) to proceed.

Shocking Audit: COVID Debt Relief Benefited Borrowers with Large Crypto Holdings in South Korea

A recent audit in South Korea has uncovered a startling reality about COVID-19 relief programs. The NCLAT has set aside an appeal by SEBI, where the markets regulator had asked the tribunal to recover the penalty imposed by it against an entity related to the diversion of funds in the Religare Finvest matter, saying such claims cannot be filed once the liquidation process begins under IBC.

There was no infirmity in the decision of the liquidator in not admitting the claim of SEBI arising out of the order passed by the Adjudicating Officer (AO) and filed after a delay of 797 days after the liquidation commencement date, it said.

The appellate tribunal upheld the order by NCLT and the liquidator of Annies Apparel, observing that…

What’s the worst thing you’ve ever woken up to? A missed alarm? A regretful text?

Now imagine waking up in handcuffs, in a casino security room, and being told you owe $75,000 with absolutely zero memory of how you got there.

Welcome to Las Vegas, where even your amnesia has a credit limit.

Michael Duke Thomson, a 64-year-old attorney and longtime Aria Resort Casino regular, says his night out in January 2024 started innocently enough.

He remembers leaving the high-limit blackjack room with a few thousand dollars in chips. A win! A vibe! A responsible adult moment!

The next thing he remembers is waking up the following morning in a casino holding area, cuffed, confused, and informed that he’d apparently signed eight gambling…
