Victor, N.Y. — A legal fight over Eastview Mall is intensifying, as lenders tied to a $210 million mortgage accuse the Town of Victor and mall owner Wilmorite of using eminent domain to help the company avoid its debt obligations.
Attorneys for lenders U.S. Bank and Wells Fargo filed an objection Friday ahead of Monday’s public hearing, calling Victor’s proposal to use eminent domain to acquire certain rights tied to five Eastview Mall parcels a “debt evasion scheme” that would serve Wilmorite’s private interests.
